Loons win the right to sing at 4 a.m.

A cottage association called it a noise complaint. The court called it a dawn chorus with prior rights.

Case

The association’s new by-law banned “sustained calls before 7 a.m.” on the lake. Our clients have been calling at dawn since the glaciers left, and have the summer residency to prove it.

The by-law was struck down. The association’s president has since bought earplugs, and, we are told, a field guide.
